Write to the author Sergey Valentinovich Myshak has been working as an authorized person on human rights in the Krasnodar Territory from a year. The main areas of the Ombudsman are the consideration of applications of those whose rights are violated in the region, and the legal education of citizens. Sergey Moshak spoke about what complaints most often come to the name of the Commissioner about the most memorable cases and the prospects of human rights institutes during the online conference on the KrasnodarMedia news agency.
So what is it a state? After his approval by the deputies, it will be possible to familiarize yourself with him on the website of the Commissioner. In the meantime, I can only bring some numbers and facts. First of all, I want to note that the report is based on my experience, observations and is not comprehensive. In its preparation, the data of a sociological study on compliance with the rights and freedoms of man and citizen were used.
To the question "Are human rights in the Krasnodar Territory? People mainly complained about a fair criminal and administrative investigation, they were also worried about housing problems, public issues and social security issues. The number of complaints related to the violation of the rights of persons contained in the places of compulsory content on the terms of the detention.
court decisions and almost 1.5 times more complaints about the violation of citizens of health and medical support. And this is only a small part of the information contained in my report. I hope that soon you can get acquainted with its content in full. How do you evaluate your activity in this direction? If we take the number of complaints received in the year, it should be noted that the first place is occupied by complaints about a fair criminal and administrative investigation.
Also, 2.5 times more complaints about violation of rights on the execution of court decisions were received. You can read more about this in my report for the year that will be posted on the website of the Commissioner. Have you had especially remembered cases? For example, when did the soulless officials struck you? And can you give examples when, on the contrary, the officials were imbued and helped?
I consider all appeals and try to help. There are those that are sustained in the soul. So, for example, it turned out with an appeal from Anapa. Its authors are a pensioner, a group of 3 groups and his sister, also an old -age pensioner. Having lived all their lives in the Khabarovsk Territory, they moved to the Kuban. Here they built a house, designed it as it should and wanted to connect water supply.
But there were problems with this - pensioners simply refused! Those organs that were obliged to help older people wrote long detailed answers, the meaning of which was reduced to the fact that in water supply they were refused to provide drinking water for vacationers. At my request, I also received a detailed answer from the administration, justifying their actual inaction.
And only, after my appeal to Leonid Korzhinek, who was then the prosecutor of the region, and his operational reaction, the issue was resolved. There is another example.
A pensioner from the Kushchevsky district turned to me with a request to clarify what benefits she has and what benefits were relied on. After my request to the local government bodies, deputy head of the district, the head of the district department of the Pension Fund, and employees of the social protection and family policy department immediately left for a woman. They made sure that the applicant was provided with all social support measures, answered all her questions and checked the correctness of the pension.
The authorities reacts positively to my requests, but I remembered this case with its thoroughness, the close attention of the municipality to a person. There are many more examples. If you are interested, you can familiarize yourself with them on the site of the Commissioner. What do you consider your greatest achievement? This is probably a solution to the problem of residents of an emergency house in the city of Kropotkin.
For several years, they turned to the authorities on the issue of relocation, since this house in which a person lived, including 23 children and 9 disabled people, was recognized as emergency and subject to demolition in a court. However, for three years, local authorities were inactive. On this occasion, I turned to the governor of the region Veniamin Kondratiev. As a result, on his behalf, money was allocated for the construction of new housing - about millions of rubles and in two three -story houses were commissioned.
Now people live in new apartments. There are less and less every year. And it gave it to such a kitchen partisanism with a shade of heroism. Now people have a chance to get real help only turning to the Ombudsman. But one unmandman will not be able to physically help all those in need of this. You are also part of the legal community. In your opinion, what is missing to our society so that a normal institution of protecting the rights of citizens will appear?
However, legal education is still poorly developed, many citizens are poorly oriented in their own rights. I must say that in the region there are public organizations that are engaged in legal education and providing legal assistance to citizens. We actively interact with such organizations, exchange information, and conduct consultations. It is very important that the institutions of state human rights, civil society, and the media act together.
Then, I'm sure the situation will change for the better.
